The Indian abortion laws come under the Medical Termination of Pregnancy (MTP) Act enacted in the year 1971 by the Indian Parliament to reduce the instances of unauthorized abortion and consequent maternal mortality & morbidity.
If the patient is sure that she wants an abortion, then legally and medically speaking, the earlier it is done the better. The only thing you need is to have the approval of a registered medical practitioner (RMP) so that you can proceed with the abortion in the first 3 months. After 3 months you need the approval of two RMPs. If you get the MTP done within the first 7 weeks following your last period, you might get a medical miscarriage done by prescribing some sort of medications by the gynecologist ensuring that the abortion would be successful. In this case, no surgery is required. If the 7-week deadline has expired, don’t be worried. MTPs are legal in India up to the first 20 weeks and abortion via surgery can be performed under anesthesia.
